1. The report filed by the State respondents in the first writ petition being WPA 6495 of 2026 is kept on record. This writ petition has been filed challenging two show cause notices issued by the concerned authorities by January 24, 2026 and February 9,
2026. 2. The notices have been issued seeking a suitable reply from the petitioner regarding his absence without any leave from his duties. 2

Learned Advocate appearing for the petitioner submits that he was not absent of his own volition, but he was not permitted to participate in discharging his duties by the concerned Block Development Officer (BDO). The petitioner is eager to discharge his duties. 4. The second writ petition being WPA 19558 of 2026 has been filed seeking action against the respondent no. 9, the concerned Block Development Officer (BDO). 5. The petitioner, pursuant to the direction of this Court, has already joined his present place of service and is discharging his duties therefrom since September 9, 2026. 6. Pursuant to the direction of this Court, report has been filed in the second writ petition which is also kept on record. 7. It appears from the reports filed in both the writ petitions that the authorities are agreeable to transfer the petitioner to a suitable place, wherefrom he can discharge his duties as such. 8. In view of the stand taken by the State respondents, let the transfer be effected within a period of four weeks from date. 9. The petitioner’s challenge to the show cause notices is presently not germane as the petitioner has
3 replied to the show cause notices and no disciplinary proceedings have been initiated against him as yet. 10.
Both the writ petitions are disposed of with the direction as aforestated and also recording that the petitioner, State respondents and the concerned authorities will be at liberty to proceed with any further progression in terms of the show cause notices, if so advised. The petitioner will be entitled to respond to any further notice or proceeding initiated by the concerned authorities in accordance with law. 11. With the aforestated directions, both the writ petitions are disposed of. 12. There will be no order as to costs. 13. Urgent photostat certified copy of this order, if applied for, be given to the parties, upon usual undertakings. (Reetobroto Kumar Mitra, J.)
