02/ 29.01.2026: Heard learned counsel for the petitioners and learned counsel for the State.
2. The petitioners are apprehending their arrest in connection with Pachamba P.S. Case No. 63 of 2025, registered under sections 126(2), 115(2) 117(2), 118(2), 109(1), 304(2), 3(5) of BNS, 2023, pending in the Court of learned C.J.M, Giridih.

Learned counsel for the petitioners submits that petitioners are tenant of the informant and scuffle took place due to non payment of rent. He further submits that now good sense has prevailed between the parties and the matter has been compromised between the parties in the light of Annexure-2. On these grounds, he submits that the petitioners may kindly be provided privilege of anticipatory bail.

Learned counsel for the State opposes the prayer and submits that allegations of assault are there.

Considering that petitioners are tenant of the informant and
( 2026:JHHC:2231 ) Annexure-2 is document which suggests that matter has been compromised between the parties, I am inclined to grant anticipatory bail to the petitioners. Accordingly, the above named, petitioners are directed to surrender before the learned court within three weeks from today and in the event of their surrender / arrest, the petitioners shall be released on bail, on furnishing bail bonds of Rs. 25,000/- (twenty five thousand) each with two sureties of the like amount each, to the satisfaction of learned C.J.M, Giridih, in connection with Pachamba P.S. Case No. 63 of 2025, subject to conditions as laid down under Section 482 (2) of B.N.S.S, 2023.
