This Writ Petition has been filed against the impugned order dated 28.05.2024, passed by the learned Debts Recovery Tribunal, Dehradun in RC No.448 of 2023 (OA No.49 of 2023), whereby the learned Tribunal has passed the following orders:- “(iii) The concerned Registrar/ Sub-Registrar be issued a notice for ensuring that no further sale/ transfer is registered with his office w.r.t. the properties transferred by CD No.2 Sri Sandeep Panwar to his brother Sri Pradeep Singh till further orders by this forum. (iv) The Revenue Authorities be also sent a notice for prohibition of mutation in the name of Sri Pradeep Singh qua the property which were 1 2026:UHC:869 alienated by CD No.2 Sri Sandeep Panwar till further order from this forum”. 2. Heard Mr. Lalit Bhardwaj, learned counsel for the petitioner and Mr. Ashish Joshi, learned counsel for the respondent no.1. 3. Mr. Lalit Bhardwaj, Advocate, has submitted that the petitioner was not a party before the learned Tribunal and neither any notice was issued to him nor any order was served. 4. During the arguments, Mr. Lalit Bhardwaj, Advocate, has requested to permit the petitioner Pradeep Singh to withdraw the present writ petition with liberty to file an appeal under Section 30 of the Recovery of Debts and Bankruptcy Act, 1993. 5. The said request has not been opposed by the respondent no.1. 6. The present writ petition is dismissed as withdrawn granting liberty to the petitioner to file an appeal under Section 30 of the Recovery of Debts and Bankruptcy Act, 1993, but in accordance with the law. 7.
