……for the State. Learned advocate appearing for the petitioner submits that the petitioner was arrested on 04.01.2025 and since then he is in custody. Charges have already been framed and the evidence of the victim is completed. Learned advocate for the State as well as the defacto complainant opposes the prayer for bail. 2
Learned advocate for the State has produced the case diary. Attention of the Court was drawn to the statement of the victim under Section 164 of the Code of Criminal Procedure. I have taken into account the period of detention of the present petitioner and the evidence of the witnesses. Without going into the merits of the case and the fact that some time will be required to complete the trial, I am inclined to release the petitioner on bail. As such, the prayer for bail of the petitioner is allowed. Accordingly, Petitioner, namely, Sujan Bag @ Sajan Bag @ Sajal shall furnish bond of Rs. 20,000/- (Rupees Twenty Thousand Only) with two sureties of Rs. 10,000/- (Rupees Ten Thousand Only) each. One of whom must be local to the satisfaction of Learned Judge, Special Court, Howrah. If on bail, the petitioner shall be physically present on each and every date fixed before the learned Trial Court and shall not leave the jurisdiction of District of Howrah without the prior permission of the Learned Trial Court. Additionally, petitioner shall not enter the jurisdiction of Domjur Police Station till the evidence of the vulnerable witnesses are over. Petitioner, prior to entering Domjur Police Station would seek leave of the learned Special Court in seisin of the case.
Accordingly, CRM (M) 280 of 2026 is allowed. Report submitted by the State be kept with the record. 3
