Affidavit of service filed on behalf of the petitioner and the report submitted by the State are taken on record. The petitioner who is the Pradhan of Changual Gram Panchayat has assailed the notice of meeting issued by the Prescribed Authority pursuant to a no confidence motion submitted for her removal on the ground that the notice is in violation of the provision laid down under Section 12(4) of the West Bengal Panchayat Act, 1973 since the date of meeting has been fixed beyond the period of 15 working days from the date of submission of motion. It appears from the report submitted by the State that after the motion was submitted on 1st September, 2026, there were government holidays on 4th September, 2026, 17th September, 2026 and 22nd September, 2026 besides the weekly holidays on Saturdays and Sundays. It is crystal clear from the report that the meeting has been fixed on the 14th working day after receipt of the motion and is well within the time frame prescribed under Section 12(4) of the Act.
2 In view of the above, this Court is inclined to hold that the writ petition is devoid of merit and is liable to be dismissed. The writ petition is accordingly dismissed. There shall be no order as to costs. Since no affidavit has been invited, allegations contained in the writ petition shall be deemed not to have been admitted. Urgent certified website copy of the order, if applied for, be given to the parties on compliance of requisite formalities.
