Mr. Sobhan Majumder Ms. Koyel Bag … For the petitioner 1. Affidavit of service filed in Court today is taken on record. 2. In spite of service, none appears on behalf of the respondents. 3. The petitioner retired from service on 31st December, 2025. The Pension Payment Order was issued in her favour on 22nd December, 2025, i.e., prior to her retirement. She alleges that the amount was actually credited in her bank account on 7th May, 2026. 4. The Provident Fund due of the petitioner was paid on 4th June, 2026; wherein the interest was calculated only up to 28th February, 2026. 5. The petitioner made a representation before the District Inspector of School (SE) and the Director of Pension, Provident Fund and Group Insurance seeking statutory interest on account of delayed disbursement of the gratuity, commuted value of pension and provident fund. The said representation is alleged to be kept pending. 2 6. Prayer has been made to direct the authority to grant interest on account of delayed payment. 7. The instant writ petition stands disposed of by directing the Director of Pension, Provident Fund and Group Insurance to consider the representation made by the petitioner seeking grant of interest on account of delayed payment of the provident fund dues in accordance with law at the earliest but positively within a period of eight weeks from the date of communication of this order. 8. It will be open for the petitioner to produce evidence in support of the delayed payment of the aforesaid dues. 9. If the allegation of the petitioner is found to be proper, then necessary steps for grant of statutory interest shall be taken without any further delay. 10. Learned advocate for the petitioner is directed to forward a copy of the subject representation along with all supporting documents to the aforesaid respondents at the time of communicating the order of the Court. 11. The writ petition stands disposed of. 12. All parties shall act on the basis of a server copy of this order duly downloaded from the official website of this Court. 13. Certified server copy of this order, if applied for, be supplied to the parties on compliance of all requisite formalities. (Amrita Sinha, J.)
