3. Sri K. Diwakar, learned Senior Counsel appearing for the petitioner, contended that the impugned interim
order at Annexure-V was passed by respondent No.2 without affording an opportunity of hearing to the petitioner. Learned Senior Counsel further submitted that two suits are pending
consideration in respect of the land in question and that the controversy in the present writ petition relates to an extent of 2,300 sq. ft., situated at Nagavara Palya, Kaggadasapura Main Raod, Benniganahalli, K. R. Puram Hobli, Bangalore East Taluk between the petitioner and respondent No.5, wherein the petitioner is in possession of the land in question. It was further contended that respondent No.2, without considering the plea put forth by the petitioner, proceeded to pass the impugned order at Annexure-V in haste. Therefore, in view of the

violation of the principles of natural justice, the impugned order calls for interference by this Court.
4. Per contra, Sri C.R. Gopalaswamy, learned Senior Counsel appearing for respondent No.5, contended that the rights of the petitioner are already protected by the competent Civil Court in the pending civil suits. He further submitted that the impugned order at Annexure-V is an appealable order under Section 49 of the Karnataka Land Revenue Act, 1964, and therefore, it is open to the petitioner to approach the competent appellate authority.
5. Sri Shamanth Naik, learned Additional Government Advocate, submitted that the petitioner has to exhaust the alternative remedy available under law.

6. In the light of the submissions made by the
learned counsel appearing for the parties and upon careful consideration of the impugned order at Annexure-V, it is evident that respondent No.2 has registered the petition as a disputed case and accordingly passed the impugned
order dated
18.06.2026. It is not in dispute that the said order is appealable under the Act.
7. It is also relevant to note that two suits are pending consideration in respect of the very same subject matter. However, the controversy between the petitioner and respondent No.5 is confined to an extent of 2,300 sq. ft.
8. In that view of the matter, having regard to the disputed questions of fact involved in the present writ petition and the availability of an alternative remedy under the Act, I am of the opinion that no interference

is calls for in the present writ petition. Liberty is reserved to the petitioner to approach the appellate authority in accordance with law. All contentions of the parties are kept open.
9. In the event the petitioner prefers an appeal before the appellate authority, the said authority shall dispose of the appeal as expeditiously as possible.
10. Accordingly, the writ petition stands disposed of.
11. In view of the disposal of the writ petition, all pending applications, if any, stand disposed of.
