JUSTICE S VISHWAJITH SHETTY ORAL ORDER Accused No.1 in S.C.No.5032 of 2026 pending before the Court of VIII Additional District and Sessions Judge, Mysuru sitting at Hunsur, arising out of Crime No.53 of 2026 registered by Bilikere Police Station, Mysuru for the offence punishable under Section 310(2) of BNS, 2023, is before this Court in this petition filed under Section 483 of BNSS, 2023, seeking regular Bail. 2. Heard the learned counsel for the parties. 3. FIR in Crime No.53 of 2026 was registered by Bilikere Police Station, Mysuru for the aforesaid offence against 5 unknown persons, based on the first information dated 13.02.2026 received from Ajay Kumar son of Mahadevappa. In the said case, during the course of investigation, petitioner was arrested on 06.03.2026 and remanded to judicial custody. After completing - 3 - HC-KAR CNR: KAHC010607422026 NC: 2026:KHC:53277 CRL.P No. 13390 of 2026 investigation, charge sheet is filed against 5 persons and petitioner is arrayed as accused No.1 in the charge sheet. His bail application before the Trial Court in S.C.No.5032 of 2026, which was rejected on 07.08.2026. Therefore, he is before the Court. 4. Perusal of the material on record would go to show that on 12.02.2026 at about 10.33 p.m., accused persons who came in a car in the pretext of filling diesel to their vehicle, allegedly got down from the car, armed with weapons and after threatening the staff of the petrol pump, allegedly snatched a sum of Rs.15,300/- from CW1, assaulted CW2 and thereafter escaped from the spot of crime along with the money which they had snatched. Investigation of the case is now completed and charge sheet is filed. 5. As per the charge sheet allegations, accused No.1 is said to be the driver of the car in which the accused persons arrived at the spot of crime. Accused - 4 - HC-KAR CNR: KAHC010607422026 NC: 2026:KHC:53277 CRL.P No. 13390 of 2026 Nos.2 to 5 allegedly got down from the car, armed with weapons and thereafter they snatched a sum of Rs.15,300/- from CW1, assaulted CW2 with a weapon and escaped from the spot. CW2 is said to have suffered simple injuries as a result of assault made by the accused persons. 6. Petitioner is a person with criminal antecedents and as against him another case was registered in the year 2024 for offence punishable under Section 103 of BNS, 2023. Learned counsel for the petitioner has submitted that in the said case, the petitioner has been granted bail. Insofar as the present case is concerned. Considering the nature of allegations found against the accused persons and also the fact that investigation of the case is now completed and charge sheet is filed, I am of the opinion that the prayer made by the petitioner for grant of regular bail needs to be answered affirmatively, subject to appropriate conditions. (ii) The petitioner is directed to be enlarged on bail in S.C.No.5032 of 2026 pending before the Court of VIII Additional District and Sessions Judge, Mysuru sitting at Hunsur, arising out of Crime No.53 of 2026 registered by Bilikere Police Station, Mysuru for the offence punishable under Section 310(2) of BNS, 2023, subject to the following conditions: a) The petitioner shall execute personal bond for a sum of Rs.1,00,000/- with two sureties for the likesum, to the satisfaction of the jurisdictional Court; b) The petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts his appearance for valid reasons; - 6 - HC-KAR CNR: KAHC010607422026 NC: 2026:KHC:53277 CRL.P No. 13390 of 2026 c) The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses; d) The petitioner shall not involve in similar offences in future; e) The petitioner shall not leave the jurisdiction of the Trial Court without permission of the said Court until the case registered against him is disposed off. f) The petitioner shall appear before the Station House Officer (S.H.O) of Bilikere Police Station, Mysuru on every first and third Sunday of the month between 10.00 a.m. and 1.00 p.m. and mark his attendance for the period of 1 year from the date of his released form custody.
