Accused Nos.4 and 5 in Crime No.126/2026 registered by Arakere Police Station, Mandya District, for the offences punishable under Sections 189(2), 351(2), 352, 118(1), - 3 - HC-KAR CNR: KAHC010642882026 NC: 2026:KHC:53156 CRL.P No. 14325 of 2026 C/W CRL.P No. 14224 of 2026 109(1), 324(4), 329(4) and 190 of BNS, 2023, are before this Court in these petitions filed under Section 483 of BNSS, 2023, seeking regular bail. 2. Heard the learned counsel for the parties. 3. FIR in Crime No.126/2026 was registered by Arakere Police Station, Mandya District, for the aforesaid offences against keerthan and others based on the first information dated 15.07.2026 received from Shasikumara, who is the injured victim in the present case. During the course of investigation, petitioners herein were arrested on 22.07.2026 and remanded to judicial custody. Their bail application filed before the jurisdictional Sessions Court in Crl.Misc.No.5307/2026 was rejected on 29.08.2026. Therefore, they are before this Court. 4. Perusal of the material on record would go to show that petitioners' name is not found in the FIR. In the first information, it is alleged that injured victim had enquired with accused No.3 about the quarrel that had taken place earlier between accused Nos.1 to 3 and one Rakesh S/o Suresh. - 4 - HC-KAR CNR: KAHC010642882026 NC: 2026:KHC:53156 CRL.P No. 14325 of 2026 C/W CRL.P No. 14224 of 2026 Accused No.3 had informed about the same to accused No.1, who thereafter on 14.07.2026 had called the first informant over mobile phone and had asked him to come out of his house. Accordingly, first informant had opened the door of his house and accused Nos.1 to 5, who were present outside the house allegedly quarreled with him and thereafter, assaulted him. Allegation of assaulting injured with weapons is found against accused Nos.1 and 2. Accused Nos.3 to 5, who were present with accused Nos.1 and 2 allegedly had kicked him after he had fallen down as a result of the assault made by accused Nos.1 and 2. Accused No.1 in the present case is already arrested and remanded to judicial custody. Petitioners, who are arraigned as accused Nos.4 and 5, do not have any other criminal antecedents. Considering the aforesaid aspects of the matter, the following order:- 5. The petitions are allowed. The petitioners are directed to be enlarged on bail in Crime No.126/2026 registered by Arakere Police Station, Mandya District, for the offences punishable under Sections 189(2), 351(2), 352, 118(1), - 5 - HC-KAR CNR: KAHC010642882026 NC: 2026:KHC:53156 CRL.P No. 14325 of 2026 C/W CRL.P No. 14224 of 2026 109(1), 324(4), 329(4) and 190 of BNS, 2023, subject to the following conditions: a) Petitioners shall execute a personal bond for a sum of Rs.1,00,000/- each with two sureties for the likesum, to the satisfaction of the jurisdictional Court; b) The petitioners shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts their appearance for valid reasons; c) The petitioners shall not directly or indirectly threaten or tamper with the prosecution witnesses; d) The petitioners shall not involve in similar offences in future; e) The petitioners shall not leave the jurisdiction of the Trial Court without permission of the said Court until the case registered against them is disposed off.
