1) Affidavit of service filed on behalf of petitioner is taken on record. 2) Learned advocate representing petitioner complains of overt action on the part of concerned police authorities thereby permitting private respondents to cultivate land in question and denying right of petitioner to cultivate said land. It is submitted that such steps are being taken by concerned police authorities after order was passed by the learned Additional District Judge, 4th Fast Track Court, Alipore, South 24 Parganas on Misc. Appeal No. 266 of
2024. 2 3) State respondents and private respondents are represented by learned advocates. 4) It appears from respective submissions made on behalf of parties that an order was passed by learned Civil Judge (Senior Division), 9th Court (I/C), Alipore, South 24 Parganas on an injunction application thereby directing issuance of notice upon defendants to hear both parties to aforesaid suit on a subsequent date. Against said order dated 12th July, 2024 Misc. Appeal was preferred by plaintiffs and an order was passed on 29th June, 2026 thereby directing parties to maintain status quo in respect of nature, character and possession over suit property till disposal of injunction application by trial court. Vide said order dated 29th June, 2026, trial court was also requested to dispose of prayer for injunction after granting opportunity of hearing to parties to said suit. 5) If petitioner finds that in terms of said order dated 29th June, 2026 passed by the appellate court concerned police authorities are taking steps, in that event petitioner needs to approach appropriate forum in pursuit of remedy. At this stage, this Court declines to pass order thereby directing police authorities to take steps which would facilitate petitioner to cultivate land in question since issue is pending before the civil court. 6) Hence, writ petition stands dismissed. 7) However, this order shall not preclude petitioner to take steps in accordance with law.
