Petitioner has filed this writ petition seeking following reliefs:- “10.1. That the Hon’ble Court may be pleased to issue appropriate writ/order/direction, to quash the impugned suspension order dated (Annexure P-3) and revoke the suspension of the petitioner. 10.2. That the Hon’ble Court may be pleased to issue appropriate writ/order/direction, and direct the respondent authorities to disburse the subsistence allowance for the month of February, 2026 onwards. 10.3. Any other relief(s), direction(s), which the Hon’ble Court deems fit and proper, including the cost of the petition, may be granted, in the circumstances of the case. ” 2. Learned counsel for the petitioner submit that the petitioner while holding a substantive post of Headmaster and working as Hostel Warden (Adhikshak) was suspended on 03.09.2025 and till date the chargesheet has not been issued even after lapse of more than 90 days and therefore, according to the provision, revocation of suspension is automatic. The petitioner has submitted a representation before the respondent No.6 which is pending consideration. At this stage, petitioner prays for direction to the respondent No.6 to consider and take decision on the representation filed by him at the earliest preferably within a specific time period. He also submits that the petitioner has not been paid the subsistence allowance since February, 2026. 3 3. Counsel for the State submits that as petitioner is not pressing this petition on merits and only seeking a direction to consider and take decision on the representation, he is having no objection to the limited prayer made. 4. On due consideration of the submission of learned counsel for respective parties, nature of grievance raised in this writ petition, this writ petition at this stage is disposed of directing the respondent No.6 to consider and take decision on the representation dated 12.12.2025 submitted by the petitioner in accordance with law, taking note of the rule 9 of the CCA Rules, 1966 expeditiously preferably within further period of four weeks from the date of receipt of representation. 5. The concerned authority shall also consider and take appropriate orders with regard to payment of subsistence allowance to the petitioner within that period. 6.
