O R D E R This Writ Petition is filed seeking the following relief:
“….to issue an appropriate Writ, Order or direction more particularly one in the nature of Writ of Mandamus declaring the action of the respondents in withholding the net payment of pending amount of Rs.31,95,847/- (Rupees Thirty One Lakhs Ninety Five Thousand Eight Hundred and Forty Seven only) even after finalizing the bills payable to the petitioner in relation to the works i.e. Package No.APAM/PLND/VINUKONDA/11 consisting of 6 works in Vinukonda Constituency of Palnadu District vide Agreement No.36/2023-24, dt. 14.12.2023, and pass any other order or orders …”

Heard learned counsel for the Writ Petitioner, learned Assistant Government Pleader for Panchayat Raj and Rural Development representing respondent Nos.1 to 3, learned Assistant Government for Finance and Planning, representing respondent No.4 and learned Assistant Government Pleader for Agriculture Marketing, representing respondent Nos.5 and 6. 3. The Writ Petitioner claims to be a Civil Contractor used to execute works of R&B Department, Panchayat Raj Department and other Government Departments; that the Writ Petitioner and respondents entered into Agreement dated 14.12.2023 in respect of the work Package No.APAM/PLND/VINUKONDA/11 consisting of 6 (six) works in Vinukonda Constituency of Palnadu District. Writ Petitioner completed the works as per the schedule and as per the terms of the Agreement. The respondent authorities, after satisfying the work recorded in M-Book, passed an order for an amount of Rs.31,95,847/-. Though the final bill was prepared and passed, the amount remained unpaid despite repeated requests. (b). It is the grievance of the Writ Petitioner that though he has been approaching the respondent authorities for payment of amount in respect of the work done by him, no action has been taken by them. According to Writ Petitioner, having executed the work satisfactorily and within the prescribed time, non-payment of the bill amount was arbitrary and unjustified. It was further contended that the delay in payment is causing severe financial hardship, necessitating the filing of the present Writ Petition seeking appropriate directions for release of the outstanding amount. 4.
Learned Assistant Government Pleader for Panchayat Raj and Rural Development, on written instructions received from the Executive Engineer/FAC, (PR) PIU Division, Guntur-3rd respondent, submits that the Writ Petitioner is entitled to a net amount of Rs.31,95,847/- after standard deductions such as QC recovery etc., aggregating to Rs.14,315/-. Government Pleader further submits that as per Schedule-B of Agreement, GST amount added to the value of work done by the Writ Petitioner, and as the Agricultural and Cooperation (MKTG.II) Department authorities did not provide the relevant Head of Account in Administrative Sanction, vide Lr.Rc.No.A1/AMC Grant/ 2025, dt.14.11.2025, 3rd respondent addressed a letter to the Chief Engineer, PR-II, Vijayawada, requesting the said authority to address a letter to the officials concerned, for issuance of relevant Head of Account and to release grant. The written instructions are placed on record. 5. Having regard to the fact that, there is no dispute with regard to the works executed by the Writ Petitioner and the amount payable to him, and in view of the submissions of the learned Assistant Government Pleader for Panchayat Raj and Rural Development, the respondent authorities are directed to pay a sum of Rs.31,95,847/- (Rupees Thirty One Lakhs Ninety Five Thousand Eight Hundred and Forty Seven only) to the Writ Petitioner within a period of Three (3) months from the date of receipt of a copy of this order.
