JUSTICE RAJESH RAI K ORAL ORDER Learned counsel for the respective parties filed a joint memo stating that the dispute between the parties have been amicably settled and they may be permitted to compound the offences and the proceedings may be quashed against the petitioners. 2. Placing reliance on memo and considering the nature of the dispute, admittedly, the offences alleged against the petitioners are non-compoundable in nature. However, having regard to the fact that the dispute between the parties is purely private and matrimonial in nature and all the other - 3 - HC-KAR CNR: KAHC010202772024 NC: 2026:KHC:51593 CRL.P No. 3510 of 2024 cases filed between the parties were settled amicably. In view of the principles laid down by the Hon'ble Apex Court in GIAN SINGH V. STATE OF PUNJAB AND ANOTHER, reported in (2012) 10 SCC 303, I am of the considered opinion that the settlement arrived at between the parties can be taken into consideration. 3. Accordingly, the petition is allowed. 4. Consequently, the proceedings pending in C.C.No.7027/2024 (arising out of Crime No.47/2023 registered by Bellanduru Police Station) for the offence punishable under Section 380, 420, 465, 471 r/w Section 34 of IPC, presently, pending on the file of 41st Additional Chief Metropolitan Magistrate, Bengaluru, is hereby quashed against the petitioners-accused Nos.1 and 2.
