JUSTICE RAJESH RAI K ORAL ORDER Learned counsel for the respective parties jointly submit that the parties have amicably settled their dispute before the Karnataka Mediation Center, Bengaluru, in M.C.No.2448/2019 and to that effect, they placed the memorandum of settlement entered between the parties. As such, learned counsel for the petitioner submits that in view of the settlement, the proceedings against the petitioner may be quashed. 2. Learned counsel for respondent No.2 has not opposed the aforesaid prayer and submitted that in view of the settlement arrived at between the parties, the proceedings against the petitioner may be quashed. - 3 - HC-KAR CNR: KAHC010658332024 NC: 2026:KHC:51948 CRL.P No. 12867 of 2024 3. Placing reliance on their submission and the memorandum of settlement along with the order sheet in M.C.No.2448/2019, I am of the view that the continuation of proceedings against the petitioner is nothing but abuse of the process of law. 4. Though the offences alleged against the petitioner are non-compoundable in nature, having regard to the fact that the dispute between the parties is purely private and matrimonial in nature and in view of the principles laid down by the Hon'ble Apex Court in GIAN SINGH V. STATE OF PUNJAB AND ANOTHER, reported in (2012) 10 SCC 303, I am of the considered opinion that the settlement arrived at between the parties can be taken into consideration. 5. Accordingly, the petition is disposed of. 6. The proceedings against the petitioner/accused No.1 in C.C.No.50168/2021 (arising out of Crime No.134/2019 registered by Viveknagar Police Station) for the offences punishable under Sections 498A of IPC and Sections 3 and 4 of Dowry Prohibition Act, 1961, presently, pending on the file of - 4 - HC-KAR CNR: KAHC010658332024 NC: 2026:KHC:51948 CRL.P No. 12867 of 2024 XXIX Addl.
