JUSTICE ANANT RAMANATH HEGDE ORAL ORDER Heard the learned counsel appearing for the petitioner, learned High Court Government Pleader appearing for respondent No.1-State. 2. This petition is filed to quash the proceedings in C.C. No.4546/2025 arising from Crime No.399/2024 registered by Bommanahalli Police Station for the offences alleged are under Section 118(1), 118(2), 3(5), 351 and 49 of Bharatiya Nyaya Sanhita, 2023. 3. Learned counsel appearing for the petitioner would submit that the charge sheet is filed without there being any basis. It is the contention that in the complaint the allegation is that unknown persons came and assaulted the complainant and in the hospital complainant has given a similar statement, but in the last part of the complaint, complainant has referred to Digitally Signed by ANANT RAMNATH HEGDE - 3 - HC-KAR CNR: KAHC010592812026 NC: 2026:KHC:50982 CRL.P No. 13327 of 2026 the petitioner's name stating that the bystander has informed that the petitioner is responsible for the incident. 4. Learned counsel for the petitioner would urge that no call detail records have been produced to show that the petitioner telephonically instructed the remaining accused to assault the complainant. 5. It is the further submission that the entire charge sheet is based on the statement of the co-accused. 6. Learned High Court Government Pleader would submit that the charge sheet is filed after investigation and charge sheet materials would indicate that the petitioner is also involved in the commission of the offence. 7. The Court has considered the contentions raised at the Bar and perused the records. 8. In the complaint, the petitioner's name is mentioned, to say that he was present at the time of alleged incident. The petitioner is not a stranger. The petitioner is said to be the former employee of the complainant. The incident is Digitally Signed by ANANT RAMNATH HEGDE - 4 - HC-KAR CNR: KAHC010592812026 NC: 2026:KHC:50982 CRL.P No. 13327 of 2026 allegedly witnessed by an eye-witness. The eye-witness has allegedly identified the assailants and the assailants allegedly have made a statement that the petitioner has instigated the assailants to assault the complainant. 9. The contentions raised in the petition are based on disputed questions of facts. These contentions are to be tested in a trial. 10. Accordingly, the Criminal Petition is dismissed. 11. Observations made in this order are only confined to the merit of the petition filed under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023. It should not be construed as an expression of the merits of the defence to be raised by the petitioners. 12. All contentions are kept open.
