Kausik (Rejected) CRM (M) 1835 of 2026 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with Howrah Police Station Case No. 23 of 2024 dated 21.01.2024 under Sections 489B/489C of the Indian Penal Code, 1860. And In the matter of : Sk. Abid Ali @ Abid ……Petitioner. Ms. Sabrina Parveen ……for the Petitioner. Ms. Soma Mishra Chatterjee Ms. Casurina Chatterjee ….for the State. Learned advocate appearing for the petitioner submits that petitioner is in custody for more than 2 years 8 months and the recovery in the present case is 42 FICN of Rs. 100/- denomination. There has been no progress in the case for last one year. As such, petitioner prays for bail. State submits that evidence of 8 witnesses have been completed out of the cited 12 witnesses. Presently prosecution is progressing with PW 9. Learned Trial Court is directed to complete the prosecution witnesses by 31st January, 2027. In case, after efforts being exerted, for reasons otherwise, the trial cannot be concluded pursuant to the petitioner co-operating with the 2 Trial Court within the time frame directed above, in that case, on an application for bail, the Trial Court will leniently consider the prayer for bail of the petitioner. Accordingly, CRM (M) 1835 of 2026 is dismissed. Memo of Evidence submitted be kept with the record. All parties shall act in terms of server copy of the order downloaded from the official website of this Court.
