In terms of order dated 3rd September, 2026 matter is taken up for consideration when learned advocate representing State respondents has filed a communication dated 10th September, 2026 of Officer-in-Charge, Behala Police Station and notice sent to respondent no. 7 dated 8th September, 2026 bearing acknowledgement on behalf of said respondent no. 7. Communication dated 10th September, 2026 and notice dated 8th September, 2026 are taken on record. 2. Respondent no. 7 is represented today by learned advocate. 2

During course of hearing learned advocate representing respondent no. 6 submits that petitioner is the owner of flat no. 4F of Geetanjali Garden situates at 71 and 71B, Roy Bahadur Road, Kolkata-700053 and as such respondent no. 6 does not have objection if petitioner decides to reside at aforesaid flat. Further it is recorded in the previous order dated 3rd September, 2026 that flat no. 4F is mutated in name of the petitioner. Therefore, this Court finds no impediment in directing the concerned police authorities to take necessary steps so that petitioner can enter into the flat and stay there along with her son. 4. Petitioner shall intimate a date by sending letter to Officer-in-Charge, Behala Police Station being respondent no. 5 by 10 days from date when petitioner shall enter into the flat for her permanent stay there. On receipt of such letter respondent no. 5 shall extend necessary cooperation which will enable the petitioner to stay at the aforesaid flat along with her son without any hindrance. 5. On behalf of respondent no. 7 a bill is raised towards outstanding maintenance charge of the flat and copy of same in tabular form is placed before this Court and taken on record. 3
6. Respondent no. 7 shall be at liberty to realize maintenance charge from the petitioner in accordance with law. 7. Writ petition stands disposed of. 8. Parties to act on the server copy of this order duly downloaded from the official website of this Court.
