Shri Koushik Saha Vs. The State of West Bengal & Ors.
Mr. Shamit Sanyal Ms. Sanchayita De ….. for the petitioner
Mr. Pulakesh Bajpayee Mr. Subit Majumdar ….. for the State
1. Let affidavit-of-service, as filed in Court, be kept on record.
2. The petitioner is aggrieved that his application for compassionate appointment has not been considered.
3. There is, however, a short background to this matter. The petitioner’s father was employed as an Upper Divisional Attendant in the Department of Youth Services and Sports, Government of West Bengal. He expired sometime in September, 2024. The petitioner made an application for compassionate appointment sometime in October, 2024, which was not considered. The petitioner has approached the Hon’ble High Court by a writ petition being WPA 6644 of 2025. The said writ petition was disposed of directing the authorities to consider the application of the petitioner within a stipulated time.
4. In deference to the order of this Court dated September 11, 2025, the said application was
2 considered and disposed of on October 30, 2025, by the authorities directing the petitioner to file a fresh application in the prescribed format. It is, pursuant to this direction of October 30, 2025, that the petitioner has filed an application in the prescribed format, albeit after some delay in July, 2026. However, since there are no prescribed timelines, the time taken by the petitioner of approximately nine months to file the application should not be a deterrent to consider the same in accordance with law.
5. The concerned authority is directed to consider the application of the petitioner made in the prescribed format within a period of six weeks from date and inform the petitioner of the resultant order, if found eligible. The consequential steps to give appointment, if found to be eligible, to the petitioner will be done as expeditiously as possible preferably within a period of four weeks thereafter.
6. With the aforestated directions, the writ petition is disposed of.
7. There will be no order as to costs.
8. Urgent photostat certified copy of this order, if applied for, be given to the parties, upon usual undertakings. (Reetobroto Kumar Mitra, J.)
