ORAL ORDER
Since Criminal Petition No.12515/2026 is dismissed as withdrawn, the office objection relating to maintainability is overruled.
2. Heard the learned counsel appearing for the petitioners, learned Additional State Public Prosecutor for respondent No.1-State.
3. The petition is filed to quash the proceedings in C.C. No.9310/2026 arising out of Crime No.455/2026 pending before Chief Judicial Magistrate, Bengaluru for the offences punishable are under Sections 115(2), 126(2), 3(5), 324, 351(2) and 352 of Bharatiya Nyaya Sanhita, 2023. Learned counsel for the petitioners referring to the contents of the complaint and the charge sheet would submit that there are no allegations against the petitioners. The charge sheet contents do not attract any of the offences. One of the petitioners has also lodged a complaint and charge sheet is filed based on the said complaint relating to the same incident. Thus, learned counsel would contend that the petition has to be quashed.

Learned Additional State Public Prosecutor would submit that the complainant has lodged the complaint against the petitioners and thereafter one of the petitioners has lodged the complaint as a counter blast. In both the cases, charge sheet is filed. Since there is a case and counter case, the presence of parties at the place of incident is admitted by the parties and there is a wound certificate reflecting the wound and the contents of the charge sheet would clearly indicate that the ingredients of offences are made out, as such learned Additional State Public Prosecutor, would contend that the petition has to be dismissed. 6. The Court has considered the contentions raised at the Bar and perused the records.
7. Admittedly, the complaint which has given rise to the present charge sheet is the first complaint. The complaint filed by the petitioners is the second complaint. Both complaints refer to the same incident. Thus, the presence of the parties at the scene of the offence is admitted.
8. The wound certificate would reflects the wounds on the victim. The contentions raised by the petitioners that, incident has not taken place, cannot be accepted at this stage. The contention is based on disputed facts which require trial before final adjudication.
9. The Criminal Petition is dismissed as the Court has found that there are materials to proceed further and to hold trial.
