JUSTICE S VISHWAJITH SHETTY ORAL ORDER Accused No.5 in Crime No.229 of 2026 registered by Sampigehalli Police Station, Bengaluru City for the offences punishable under Section 27(b) and 22(b) of NDPS Act, 1985, is before this Court in this petition filed under Section 483 of BNSS, 2023 seeking regular bail. 2. Heard the learned counsel for the parties. 3. FIR in Crime No.229 of 2026 was registered by Sampigehalli Police Station, Bengaluru City for the offence punishable under Section 27(b) of NDPS Act, 1985 against petitioner and others, based on the first information dated 26.06.2026 received from Ashok Kamagona, Police Officer - 3 - HC-KAR CNR: KAHC010570402026 NC: 2026:KHC:52127 CRL.P No. 12651 of 2026 attached to Sampigehalli Police Station, Bengaluru City. In the said case, the petitioner was arrested on 26.06.2026 and remanded to judicial custody. His bail application filed before the jurisdictional Sessions Court in Crl.Misc.No.6659 of 2026 was rejected on 30.07.2026. Therefore, he is before this Court. 4. First information has been submitted by the Police Officer attached to Sampigehalli Police Station, who had received information that about 15 to 20 persons had gathered near a masjid within the jurisdiction of Sampigehalli Police Station and were shouting and causing trouble to the public. Therefore, first informant had gone to the said spot along with his staff, apprehended some of the accused including the petitioner and thereafter, FIR was registered in the present case for offence punishable under Section 27(b) of the Act, with an allegation that the apprehended accused had consumed narcotic drugs. During the course of investigation, after the petitioner was arrested, 29.2 grams of contraband articles allegedly - 4 - HC-KAR CNR: KAHC010570402026 NC: 2026:KHC:52127 CRL.P No. 12651 of 2026 MDMA, was seized from the scooter of the accused No.1, which was parked near his house. Thereafter, the offence punishable under Section 22(b) of the Act was invoked in the present case. 5. Undisputedly, there is no seizure of contraband articles from the possession of the petitioner in the present case. Allegation against him is about consumption of narcotic drugs. 6. Learned counsel for petitioner has submitted that the petitioner has no other criminal antecedents. 7. Under the circumstances, I am of the opinion that the prayer made by the petitioner for grant of regular bail needs to be answered affirmatively, subject to appropriate conditions. Accordingly, the following: O R D E R (i) The Criminal Petition is allowed. - 5 - HC-KAR CNR: KAHC010570402026 NC: 2026:KHC:52127 CRL.P No. 12651 of 2026 (ii) The petitioner is directed to be enlarged on bail in Crime No.229 of 2026 registered by Sampigehalli Police Station, Bengaluru City for the offences punishable under Section 27(b) and 22(b) of NDPS Act, 1985, subject to the following conditions: a) The petitioner shall execute personal bond for a sum of Rs.1,00,000/- with two sureties for the likesum, to the satisfaction of the jurisdictional Court; b) The petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts his appearance for valid reasons; c) The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses; d) The petitioner shall not involve in similar offences in future; e) The petitioner shall not leave the jurisdiction of the Trial Court without - 6 - HC-KAR CNR: KAHC010570402026 NC: 2026:KHC:52127 CRL.P No. 12651 of 2026 permission of the said Court until the case registered against him is disposed off.
