NO. 133, SHIKA TOWERS, RAMAVILASA ROAD, MYSURU - 570 024. …RESPONDENTS
THIS REVIEW PETITION IS FILED UNDER SECTION 114 R/W ORDER 47 RULE 1 OF THE CPC, PRAYING THAT THIS HON'BLE COURT BE PLEASED TO REVIEW THE JUDGMENT DATED:14.12.2023 IN MFA NO.2756/2019 (ECA) , IN THE INTEREST OF JUSTICE AND EQUITY.
THIS PETITION, COMING ON FOR FINAL HEARING, THIS DAY, ORDER WAS MADE THEREIN AS UNDER:
CORAM: HON'BLE MR. JUSTICE RAVI V HOSMANI ORAL ORDER
This review petition is filed seeking for review of
judgment dated 14.12.2023 passed by this Court in MFA no.2756/2019. As there is delay application filed for condonation, since delay wasn ot substantial, counsel was heard on grounds for review.
2. Smt Suma K, learned counsel for petitioner reiterated assertion in para 6 of petition that review petitioners, who were respondents in appeal were heard as they did not receive notice and therefore, disposal of appeal without notice to them, was an error apparent on face of record and on that ground prayed for allowing review petition.

3. Heard learned counsel and perused order as well as records. Contrary to specific contention it is seen that notices were issued, petitioners were served in month of July’ 2020. Thereafter, appeal was disposed of in month of December
2023. Therefore, not only on ground that assertion about no notice was issued nor received by petitioners being incorrect, but also on ground that sufficient time had lapsed after service till disposal, there is no error apparent face on record.
4. In view of above, though there is delay in filing review petition and I.A.no.1/2024 is filed seeking for condonation of delay in filing review petition, in view of grounds on which review is sought, are held untenable, no useful purpose would be served by examining reasons for delay.
5. Hence, I.A.no.1/2024 as well as review petition are dismissed.
