1. Affidavit of service filed by the petitioner in Court today be kept with the records.
2. None appears on behalf of the State respondent in spite of service.
3. The petitioner’s prayer seeking higher scale of pay on account of enhancement of his educational qualification in terms of the judgment passed by the Hon’ble Special Bench of this Court on 7th February, 2024 in a batch of writ petitions, one of which was WPA 303 of 2023 (Utpal Kanti Karan –Vs State of West Bengal & Ors.) is pending consideration before the respondent authority.
4. Without entering into the merit of the claim of the petitioner, the instant writ petition stands disposed of by directing the District Inspector of Schools to consider the prayer of the petitioner for grant of higher scale of pay in light of the judgment delivered by the Hon’ble Special Bench at the earliest but positively
2 within a period of eight weeks from the date of communication of this order.
5. If the prayer of the petitioner to receive higher scale of pay is accepted by the authority, then necessary consequential steps shall be taken without any further delay.
6. Learned advocate for the petitioner is directed to forward a copy of the subject representation along with all supporting documents to the aforesaid respondent at the time of communicating the order of the Court.
7. The writ petition stands disposed of.
8. Parties to act on the basis of the server copy of this order duly downloaded from the official website of this Court.
9. Certified server copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
