---- 02/22.01.2026 Heard learned counsel appearing for the petitioners as well as the learned counsel appearing for the State.
2. The petitioners are apprehending their arrest in connection with Palajori P.S. Case No.112 of 2023 for the alleged offences registered under Sections 147, 149, 323, 448, 425, 427 and 353 of Indian Penal Code pending in the Court of learned Judicial Magistrate 1st Class, Madhupur.

Learned counsel appearing for the petitioners submits that the allegations are made that 22 persons have entered into the house of Jamshed Ansari and started digging the coffin in the house

itself and on call by somebody police has arrived on the spot and thereafter some altercation took place, however, the body of the wife of Jamshed Ansari has been buried in the cemetery. He further submits that the petitioner has got no criminal antecedent as disclosed in paragraph No.9 of the petition.

Learned counsel appearing for the State opposes the prayer and submits that the allegations are there against 22 persons of forcefully entering into the house of Jamshed Ansari.

Considering that the allegations are there against 22 persons and that allegation are general and omnibus against all the accused persons and on arrival of the police official the body was buried in the cemetery and the petitioners have got no criminal antecedent as disclosed in paragraph No.9 of the petition and in that view of the matter the petitioners are directed to surrender before the learned Court within two weeks and the learned Court shall release the petitioners on such terms and conditions or the sureties as the learned Court may deem fit and proper.
