……for the State. Learned advocate appearing for the petitioner submits that petitioner is the husband who has been implicated in the present criminal case after the wife committed suicide at her matrimonial home. Petitioner is in custody since 27th March,
2026. Charge sheet has already been submitted and the incident took place after 5 years of marriage. Learned advocate for the State opposes the prayer for bail, produces the case diary. 2
I have taken into account the statement of the witnesses including the post-mortem report. There are no physical injuries reflecting in the post-mortem report and the doctor’s opinion reflect that death was due to hanging anti- mortem in nature. Having considered that the prosecution has relied upon 17 witnesses in order to prove its case and the fact that there are no other antecedents of the present petitioners, I am inclined to release the petitioner on bail. Accordingly, prayer for bail of the petitioner is allowed. As such, petitioner, namely Manas Maity be enlarged on bail subject to furnishing bond of Rs. 20,000/- (Rupees Twenty Thousand Only) with two sureties of Rs. 10,000/- (Rupees Ten Thousand Only) each, one of whom must be local to the satisfaction of Learned ACJM, Kakdwip, South 24 Parganas. If on bail, the petitioner shall be physically present on each and every date fixed before the learned Trial Court and shall not leave the jurisdiction of District of South 24 Parganas without the prior permission of the learned Trial Court. Accordingly, CRM (M) 2286 of 2026 is allowed. Memo of Evidence submitted be kept with the record. All parties shall act in terms of server copy of the order downloaded from the official website of this Court.
