59 jdt. 23.09.2026 jb. WPA 15473 of 2026 (Sima Banerjee vs. State of West Bengal & Ors.) Mr. Palash Bapari …. For the Petitioner Mr. Madhu Jana Ms. Puja Sonkar …. For the State R. Islam P Alam Md. Minhaj Mr. S. Nandi …. For the Private Respondents Affidavit of service filed by the petitioner is taken on record. The petitioner alleges that the private respondents have raised construction on a plot of land classified as Sali in the L.R. Record of Rights without conversion of the same and without obtaining sanctioned plan from the concerned Panchayat. Learned counsel for the private respondents produces a copy of the conversion certificate as well as sanctioned plan which indicate that the land has been converted to bastu and construction has been raised in terms of sanctioned building plan issued by the concerned Panchayat. Therefore it cannot be said that the construction is either without conversion of the land or without sanctioned building plan. 2 The writ petition, being devoid of merit, is dismissed. There shall be no order as to costs. Since no affidavit has been invited, allegations contained in the writ petition shall be deemed not to have been admitted. Urgent certified website copy of the order, if applied for, be given to the parties on compliance of requisite formalities. (Suvra Ghosh, J.)
