Smt. Sriranjani Deb Roy (Das) Vs. Sri Sourabh Das & Ors.
Ms. Sohini Adhikari, Ms. Arpita Adhikari
…for the petitioner
In this application, the petitioner has prayed for a direction upon the Court below for expeditious disposal of A.C. Case No.3110 of 2018, presently pending before Judicial Magistrate, 6th Court, Alipore. Being aggrieved by the inordinate delay caused in disposal of the said proceeding, learned Counsel for the petitioner submits that the petitioner herein initiated a proceeding under Section 12 of the Protection of Woman from Domestic Violence Act, 2005 on
24.07.2018. In the said proceeding, the petitioner has also filed an application seeking interim monetary relief under Section 23 (1) of the Act of 2005 on the same date, i.e. on 24.07.2018. Since then more than 8 years have already been passed but the said application filed under Section 23(1) of the Act of 2005 has not been disposed of. Accordingly, she prayed for necessary direction upon the Court below for expeditious disposal of the said application.
2 Having heard learned Counsel for the petitioner and that the prayer made by the petitioner is innocuous and if it is allowed in terms of the prayer made in the application, the opposite party will have no cause to prejudice and, as such, service of copy of application upon the opposite party is disposed with. Having considered that the prayer seeking interim monetary relief for both the wife and the son pending for 8 years, I find that the prayer made by the petitioner is justified and required to be allowed to secure the ends of justice. In view of above, the instant application being CRR 2761 of 2026 is hereby disposed of with a direction upon the Court below to dispose of the petitioner’s prayer for interim monetary relief made under Section 23(1) of the Act of 2005 on the next date, i.e. on 28.12.2026 or within a period of 30 days thereafter. Parties to act on a server copy of this order duly collected from the official website of the Hon’ble High Court, Calcutta.
