ORAL ORDER
1. The limited grievance raised in the present petition is that the trial Court has proceeded to record the evidence of the defendants without considering the application filed by the petitioners under Order XII Rule 6 of the CPC.
2. The suit is one for partition and separate possession. The petitioners have filed the application seeking a judgment and decree dismissing the suit on the basis of the admissions made in the pleadings, the affidavit filed in lieu of examination-in- chief and the deposition of PW1, including the cross- examination, which stands corroborated by the exhibits placed on record.

Learned counsel appearing for the petitioners submits that, if the evidence of the defendants is recorded without first

adjudicating the application filed under Order XII Rule 6 of the CPC, the very purpose of filing the said application would be defeated.
4. Considered the submissions made by the learned counsel for the petitioners.
5. Considering the limited prayer made in the present petition and the order that this Court proposes to pass, notice to the respondents is unnecessary and is accordingly dispensed with.

This Court finds justification in the submission made by the learned counsel for the petitioners that, if the defendants’ evidence is insisted upon without adjudicating the pending application filed under Order XII Rule 6 of the CPC, the very purpose of the said application would be defeated and the application would be rendered infructuous. As pleaded in the said application, certain valuable rights may have accrued in favour of and for the benefit of the petitioners. In that view of the matter, the trial Court is directed to dispose of the

application filed under Order XII Rule 6 of the CPC before proceeding to record the evidence of the defendants.
