Accused no.2 Crime No.262 of 2026 registered by Doddapete Police Station, Shivamogga District for the offences punishable under Sections 126(2), 352, 351(2), 109(1) r/w Section 3(5) of BNS, 2023 is before this Court in this petition filed under Section 483 of BNSS, 2023 seeking regular bail. 2. Heard the learned counsel for the parties. 3. FIR in Crime No.262 of 2026 was registered by Doddapete Police Station, Shivamogga District against Mohammed Riyab and the petitioner herein, based on the first information dated 18.07.2026 received from Sri Mohammed Mosin, who is the injured victim, in the present case. The petitioner was arrested on 21.07.2026 and remanded to judicial custody. His bail application filed before the jurisdictional Sessions Court in Crl.Misc.No.845/2026 was rejected on 17.08.2026. Therefore, he is before this Court. 4. A reading of the first information would reveal that on 18.07.2026, accused no.1 called the first informant near - 3 - HC-KAR CNR: KAHC010642842026 NC: 2026:KHC:52188 CRL.P No. 14303 of 2026 Keshava canteen at Manjunatha layout and enquired about his brother. Accused no.1 allegedly informed the first informant that he has to collect hafta from his brother Farooq. Subsequently, when the first informant was returning, accused nos.1 and 2 intercepted him and assaulted him with weapons and caused injury. 5. Learned HCGP on instruction fairly submits that injury suffered by the alleged victim are simple in nature and it is stated that the petitioner has no other criminal antecedents. Petitioner has undertaken to cooperate with the investigating officer for the purpose of investigation. Accordingly, the following:- ORDER (i) Criminal petition is allowed. (ii) The petitioner is directed to be enlarged on bail in Crime No.262 of 2026 registered by Doddapete Police Station, Shivamogga District for the offences punishable under Sections 126(2), 352, 351(2), - 4 - HC-KAR CNR: KAHC010642842026 NC: 2026:KHC:52188 CRL.P No. 14303 of 2026 109(1) r/w Section 3(5) of BNS, 2023, subject to the following conditions:- a) The petitioner shall execute a personal bond for a sum of Rs.1,00,000/- (Rupees One Lakh only) with one surety for the likesum, to the satisfaction of the jurisdictional Court; b) The petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts his appearance for valid reasons; c) The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses; d) The petitioner shall not involve in similar offences in future.
