THIS PETITION, COMING ON FOR PRELIMINARY HEARING, THIS DAY, ORDER WAS MADE THEREIN AS UNDER: CORAM: HON'BLE MR. JUSTICE S SUNIL DUTT YADAV ORAL ORDER 1. The present petition has been filed seeking for issuance of writ of mandamus directing respondent No.2 to consider the representation dated 21.05.2026 at Annexure-E. The representation has been made by the - 3 - HC-KAR CNR: KAHC010459192026 NC: 2026:KHC:52133 WP No. 20913 of 2026 petitioner asserting that though the petitioner has retired five years prior to making of the representation his pension benefits has not been settled. 2. Learned Government Advocate appearing for the respondents submits that respondent No.4 is the competent authority to forward the correct details of pay scale to respondent No.2, after taking note of increments and additions as asserted by the petitioner after due verification from records. 3. It is further submitted that Principal in terms of Annexure-D, though has taken note of the pay scale after additions, however, relevant records and a proposal has to be sent by respondent No.4 to respondent No.2 for the specific purpose of determining the pension benefits. It is submitted that if such a proposal is made, respondent No.2 would take appropriate steps. 4. In light of such stand, respondent No.4 is directed to send a proposal to respondent No.2 specifically - 4 - HC-KAR CNR: KAHC010459192026 NC: 2026:KHC:52133 WP No. 20913 of 2026 in the context of the fixation of pensionary benefits after taking note of Annexure-D. Such proposal to be sent to respondent No.2 by respondent No.4 within four weeks from the date of receipt of certified copy of this order. 5. Thereafter, respondent No.2, if all records are complete, to take appropriate decision within a further period of four weeks thereafter.
