Heard the learned counsel appearing for the respective parties.
2. This petition is filed praying this Court to quash the FIR in Cr.No.100/2019 for the offences punishable under Sections 498A, 504, 506, 323, 114, 324 of IPC and under Sections 3 and 4 of D.P Act on the file of the Principal Civil Judge and JMFC Court, Kanakapura.

The learned counsel for the petitioners filed a memo along with copy of the order passed in MFA No.2656/2021 wherein petitioner No.2 herein is the appellant and the matter was settled and the respondent therein has agreed to pay an amount of Rs.55,00,000/- towards full and final settlement in respect of the maintenance and paid the amount by way of Demand Drafts as referred in the order. The counsel also brought to notice of this Court, paragraph 5 of the said order wherein it is mentioned that there shall be no claims or counter claims between the parties. All the cases filed against each other shall be withdrawn/closed by filing necessary application before the competent courts and also by filing application under Section 482 of Cr.P.C before this Court. Both the parties shall co-operate for the closure of the cases as mentioned in the table inclusive of Crime No.100/2019. The counsel submits that this Cr.No.100/2019, having filed the charge sheet, has been numbered as C.C.No.720/2021 on the file of Principal Civil Judge and JMFC, Kanakupura and the said case is mentioned in Sl.No.1 of the table of MFA. In view of the settlement arrived between the parties, though the petition is filed seeking for

quashing complainant/respondent, not coming forward in view of the settlement arrived between the parties in MFA and respondent No.2 is the complainant in the present case. Hence, in view of settlement arrived between the parties, this petition is requires to be allowed.
4. In view of the discussions made above, I pass the following:
ORDER (i) The petition is allowed. (ii) The FIR in Cr.No.100/2019 for the offences punishable under Sections 498A, 504, 506, 323, 114, 324 of IPC and under Sections 3 and 4 of D.P Act on the file of the Principal Civil Judge and JMFC Court, Kanakapura, now numbered as C.C.No.720/2021 is hereby quashed. (iii) In view of disposal of the main petition, I.A. if any, does not survive for consideration and the same stands disposed of.
