Singh … for the State-respondent(s) Mr. Kumar Jyoti Tewari Mr. Aniruddh Tewari … for the defacto-complainant Learned advocate for the petitioner submits that the petitioner has cooperated with the investigating agency and has also presented himself with the Investigating Officer of the case on 13th July, 2026. Inspite of the same, the petitioner was arrested on 19th August, 2026 and is in custody for about 33 days. Learned advocate for the defacto-complainant opposes the prayer for bail and submits that there are materials to suggest that the petitioner during the period when he was at the helm of affairs, he took 47.4 lakh from the college account. Subsequently, he refunded Rs. 25.2 2 lakh to the college account. Thereafter, the said amount of money was again returned back to the petitioner from the said college account. Learned advocate for the State produces Memo of Evidence. I have taken into account the case diary wherein the statement of nine witnesses has been recorded. However, no bank accounts have been crosschecked by the investigating officer to trace out the movement of the money. The foundational facts of the case relates to siphoning off the money from the college account. To that effect, after 33 days in custody, no material has been collected by the investigating agency. Having considered the same, I am of the opinion that the investigating agency requires fresh efforts to be exerted. However, having considered the overall circumstances, I am of the opinion that further custodial detention of the present petitioner is unwarranted. Hence, the prayer for bail of the petitioner is Allowed. Accordingly, the petitioner viz, Alok Kumar Das @ Alak Kr. Das shall be released on bail upon furnishing bond of Rs.20,000/-(Rupees Twenty Thousand only), with two sureties of Rs.10,000/- (Rupees Ten Thousand only) each, 3 one of whom must be local, to the satisfaction of the learned CJM, Krishnanagar, Nadia. If on bail, the petitioner shall meet with the Investigating Officer of the case once a week till the report in final form is submitted before the learned jurisdictional court. Additionally, the petitioner shall not enter the districts of Nadia and Murshidabad without prior permission of the learned CJM, Nadia. Accordingly, CRM (M) 2374 of 2026 is allowed. Pending application(s), if any, is also disposed of. Memo of evidence submitted be kept with the record.
