1. Affidavit of service filed in Court is taken on record.
2. Complaining the inaction on the part of the municipal authorities in failing to arrest, the illegal construction in respect of the L.R. Plot Nos. 862, 863, 864, 911, 912 and 913 of Mouza Miyabazar, JL No. 183, P.S. Kotwali, Paschim Medinipur at the instance of the private respondent nos. 5, 6 and 7, the instant writ petition has been filed.
3. Mr. Ray, learned Advocate appearing on behalf of the private respondents, would submit that in respect of impugned construction, a stop work notice had been issued, however, on the basis

hearing that took place, the municipal authorities had withdrawn the stop work notice and such fact would corroborate from the communication dated 23rd December, 2025 issued by the Chairman, a copy whereof as placed before this Court is taken on record.
4. Let such communication be also made over by Mr. Ray to the learned Advocate for the Municipality and also to the petitioners.
5. Having regard to the above disclosure, no interference is called for at this stage. In my view, it shall only be appropriate to direct the municipality to consider and dispose of the petitioners’ representation dated 5th November, 2025 appearing at page 32 of the writ petition by passing a reasoned
order, upon giving an opportunity of hearing in accordance with law on an expeditious basis preferably within a period of 16 weeks from the date of communication of this order.
6. Accordingly, the instant writ petition stands
disposed of.
7. All parties shall act on the basis of the server copy of this order duly downloaded from the official website of this court.
