According to petitioner, a road and a school were constructed over his agricultural field without paying any compensation. Relief sought in the writ petition is as follows:- “i. Issue a writ order or direction in the nature of mandamus directing the respondents to pay the whole compensation (quid pro- quo) along with interest to the petitioners of their land Khet No.1042 A area 0.316 hectare and Khatauni no. is 257, Village-Maholiya, Pargana-Billari, Tehsil-Khatima, District-U.S. Nagar.” 4. Learned counsel for the petitioner submits that in identical facts in WPMS No.3442 of 2023, Co-ordinate Bench of this Court directed the District Magistrate to take decision on the representation made by the petitioner. 5. Learned State Counsel submits that she has no objection if petitioner is permitted to make representation to District Magistrate. 6. Accordingly, writ petition is disposed of with liberty to petitioner to make representation to District Magistrate concerned highlighting his grievance.
