Order 24/03/2026
1.
Learned counsel for the appellant submits that while the learned Single Judge has allowed the appellant to file required paperbook set, at the same time, treating the default on part of
[2026:RJ-JP:12263-DB] (2 of 2) [SAW-227/2026] the appellant, the interim order was vacated. He further submits that on account of default on part of the office of the lawyer, the appellant cannot be made to suffer. 2.. The order dated 07.03.2026 is under challenge before this Court. Surprisingly, the lawyer who is appearing in this appeal, is not the counsel who is appearing before the learned Single Judge in the writ petition which is pending. We would not entertain such kind of appeals before this Court. Moreover, we also notice that on 07.03.2026, the lawyer did not choose to appear before the learned Single Judge at his own will. The order passed by the learned Single Judge, therefore, cannot be said to be in any manner wrongful and no interference is required to be warranted. It is always open for the concerned writ petitioner to move appropriate second stay application, if his first stay was vacated on account of default.
3. The appeal is, accordingly, dismissed. Pending application(s) also stand dismissed.
