JUSTICE SACHIN SHANKAR MAGADUM ORAL ORDER The captioned writ petition is filed by the petitioners, who are homebuyers, seeking issuance of a writ in the nature of mandamus directing respondent Nos.1 to 3 to place on record a detailed status report indicating the steps taken and progress made in enforcing the order dated 10.07.2024 passed by the Karnataka Real Estate Regulatory Authority (for short, <RERA=), which is produced at Annexure-A. 2. Heard the learned counsel appearing for the petitioners and the learned counsel appearing for respondent Nos.1 to 3. Perused the material on record. 3. The records disclose that the petitioners, being homebuyers, have secured an order in their favour from - 5 - HC-KAR NC: 2026:KHC:18128 WP No. 10180 of 2026 the RERA Authority dated 10.07.2024. It is not in dispute that respondent No.1 is a competent authority entrusted with the statutory duty under the provisions of the Real Estate (Regulation and Development) Act, 2016 to ensure effective and timely enforcement of the orders passed by the RERA Authority. The grievance of the petitioners is essentially with regard to the inaction and delay on the part of the respondent authorities in enforcing the said order despite of issuance of recovery certificate. 4. In the above backdrop, though this Court is not inclined to grant the specific relief sought by the petitioners in the form of a direction to place a status report on record, this Court cannot remain oblivious to the statutory obligation cast upon respondent No.1 to enforce the order passed by the RERA Authority. Therefore, in order to meet the ends of justice, a limited direction is required to be issued to ensure expeditious enforcement of the order dated 10.07.2024. - 6 - HC-KAR NC: 2026:KHC:18128 WP No. 10180 of 2026 5. For the foregoing reasons, this Court proceeds to pass the following: ORDER (i) The writ petition is hereby allowed in part. (ii) Respondent Nos.1 to 3 are directed to take all necessary steps for enforcement of the order dated 10.07.2024 passed in Complaint No.CMP/01584/2023 by respondent No.8 3 RERA Authority, as evidenced at Annexure-A, and also to give effect to the consequent Recovery Certificate dated 10.01.2025, produced at Annexure-B, in an expeditious manner and within a reasonable time frame in accordance with law.
