Affidavit of service filed by the petitioners is taken on record. The petitioners who are members of Rathbari Gram Panchayat submitted a no confidence motion for removal of the Upa Pradhan of the Panchayat pursuant to which the Prescribed Authority, by a notice issued on 14th September, 2026, fixed the date of meeting on 23rd September, 2026. The meeting was postponed due non availability of police assistance. The petitioners seek a direction the Prescribed Authority to convene the meeting and conclude the proceeding in accordance with law. Learned counsel for the State submits that further date of meeting has been fixed on 1st October, 2026 by a notice issued on 21st September, 2026. However, since the date of meeting has been fixed on 1st October, 2026, the Inspector in charge, Mathabari Police Station being the 5th respondent herein, is directed to render necessary assistance to the Prescribed Authority so that the meeting
2 is held peacefully without any disturbance from any corner whatsoever. The policy authority shall ensure safe passage of the members of the Panchayat to the venue of the meeting so that they are able to cast their votes freely, safely and independently. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities. (Suvra Ghosh, J.)
