The petitioner’s prayer for sanction of post graduate scale of pay is pending consideration before the District Inspector of Schools (Secondary Education), Birbhum. 3. Learned advocate for the petitioner submits that the issue in question has already been decided by the Larger Bench of this Court in the matter of Utpal Kanti Karan & Ors. v. State of West Bengal & Ors. reported in (2024) SCC OnLine Cal 1274. 4. As it appears that the issue in question is pending consideration before the District Inspector of Schools, accordingly no useful purpose will be served by keeping the writ petition pending. 5. The writ petition stands disposed of by directing the respondent no.3, the District Inspector of Schools (Secondary Education), Birbhum, to take a decision on the petitioner’s prayer for sanction of post graduate scale of pay in accordance with law and in line with the decision in the matter of Utpal Kanti Karan (supra) at the earliest but positively within a period of twelve weeks from the date of communication of this order. 6. An opportunity of hearing shall be granted to the petitioner prior to passing the final order in the matter. 7. If the prayer of the petitioner is allowed, then necessary consequential steps for releasing the financial benefit to the petitioner shall be taken without any further delay. 8. Learned advocate for the petitioner is directed to forward copy of all relevant documents to the aforesaid respondent at the time of communicating the order of the Court. 9. All parties shall act on the basis of the server copy of this order duly downloaded from the official website of this Court. 10. Certified server copy of this order, if applied for, be supplied to the parties on compliance of all requisite formalities. (Amrita Sinha, J.) 2
