CMA No. 514 of 2021 Civil Miscellaneous Appeal filed under Section 173 of Motor Vehicles Act against the award dated 17.02.2020 made in MCOP No.683 of 2017 on the file of the MACT (Special District Court) Dharmapuri. The judgment and decree came to be passed on 12.04.2024 in C.M.A.No.514 of 2021. Thereafter, the 4th respondent/Muthuvedi, died. Consequently, the legal heirs of the deceased Muthuvedi are impleaded and brought on record. 2. In view of the said position, the present petition has been filed seeking modification of the judgment and decree to enable the legal heirs to get their respective shares from and out of the compensation granted in Award dated 12.04.2024 in C.M.A.No.514 of 2021. 3. Learned counsel for the 1st respondent has no serious objection in allowing the petition for modification. 4. In view of the submissions made between the parties, this modification petition stands allowed. Therefore, the apportionment of award along with accrued interest pertaining to the deceased Muthuvedi, is to be shared between the legalheirs viz., for petitioner Nos.1 to 3, each 1/18 share and for petitioner Nos.5 to 9, each 3/18 share respectively. The legal heirs of Muthuvedi are at liberty to file appropriate petition before the Court concerned for withdrawal of their respective award amount as per their shares. (S.M.S.,J.)
