Learned advocate appearing for the petitioner submits that the petitioner has been implicated in connection with the instant case on the basis of alleged recovery of 26.04 kgs. of ganja. Petitioner is in custody for about 7 months and charge-sheet has already been submitted, as such, on any stringent conditions petitioner prays for bail. Learned advocate for the State opposes the prayer for bail. I have taken into account the period of detention of the present petitioner and having regard to the same, I am inclined to release the petitioner on bail. Accordingly, the prayer for bail of the petitioner is 2 allowed. The petitioner, namely, Ansarul Sk. shall be released on bail upon furnishing bond of Rs.20,000/- (Rupees Twenty Thousand only) with two sureties of Rs.10,000/- each, one of whom must be local to the satisfaction of the learned Judge, Special Court, under NDPS Act-cum-learned Additional District Judge, 5th Court, Berhampore, Murshidabad. If on bail, the petitioner shall be physically present on each and every date fixed by the learned trial court and shall not leave the jurisdiction of the district of Murshidabad without the prior permission of the learned special court. Accordingly, CRM (NDPS) 86 of 2026 is allowed. All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
