18.09.2026 Court No.35. M/L.272. Rakib (Rejected)
CRM (NDPS) 1777 of 2026
In Re: An Application for Bail under Section 439 of the Code of Criminal Procedure, 1973/Under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with NCB Crime NO.77/NCB/KOL/2021 under Sections 8(c) read with Sections 20(b)(ii)(C) and 29 of the NDPS Act.
And In the matter of : Sheikh Sahajahan @ Bada Bhai @ Sk. Sajahan
……Petitioner. Mr. Suman Majumder
......for the Petitioner. Mr. Arun Kumar Maiti (Mohanty) Mr. Sagar Saha
……for the NCB.
Learned advocate appearing for the petitioner submits that there has been no recovery from the present petitioner and he has been taken into custody on 13th of April, 2026 and since then he is in custody. Learned advocate appearing for the NCB on the other hand opposes the prayer for bail and submits a report. Report reflects that complaint was filed on 04.04.2022 and petitioner has been arrested on 13.04.2026. There are antecedents not only under the Indian Penal Code but under the Explosive Substances Act and Arms Act. Petitioner on the other hand submits that he has been granted anticipatory bail in the said case. Having considered that the petitioner was evading the process of law for more than four years at least, at this stage, I am not inclined
2 to release the petitioner on bail considering the recovery of 50 kgs of ganja. Accordingly, the prayer for bail of the petitioner in CRM (NDPS) 1777 of 2026 is dismissed. Report submitted by the State be kept with the record. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
