JUSTICE S VISHWAJITH SHETTY ORAL ORDER Accused No.9 in Special Case No.218/2026 pending before the Court of the Principal District and Sessions Judge, Mysuru, arising out of Crime No.175/2025, registered by Kankanady Town Police Station, Mangaluru City, for the offences punishable under Sections 115(2), 118(1), 351(3), 308(5), 249 read with Section 190 of BNS, 2023 and Sections 3(1), 3(2), 3(3), 3(4) of the Karnataka - 3 - HC-KAR CNR: KAHC010594182026 NC: 2026:KHC:51456 CRL.P No. 13143 of 2026 Control of Organised Crimes Act, 2000 (hereinafter referred to as 'KCOC Act, 2000' for short), is before this Court in this petition filed under Section 483 of BNSS 2023, seeking regular bail. 2. Heard the learned counsel for the parties. 3. FIR in Crime No.175/2025 was registered by Kankanady Town Police Station, Mangaluru City for the offences punishable under Section 308(4) read with Section 3(5) of BNS, 2023 against Arshad and others, based on the first information dated 30.11.2025 received from Yahiya S/o Late Ibrahim. In the said case, the petitioner was arrested and remanded to judicial custody. After completing the investigation, charge sheet is now filed against 11 accused and in the said charge sheet, the petitioner is arrayed as accused No.9. His bail application filed before the Trial Court in Special Case No.218/2026 was rejected on 10.08.2026. In the first information, it is stated by the first informant Yahiya (CW-1), that on 03.04.2025, CW-3- Mousina W/o Arshad had requested him to give his car bearing registration No.KL-60-V-3688 for the purpose of attending a marriage. Considering the said request, on 04.04.2025, CW-1 had handed over the aforesaid car to CW-3, who had promised to return the same immediately after returning from the marriage. However, she had failed to return the said car and subsequently, the first informant received a phone call from Arshad, who demanded a sum of Rs.1,50,000/- for the purpose of releasing his car. Thereafter, he received a phone call from one Noushad (accused No.2), who introduced himself as a member of Target group and demanded a sum of Rs.2,00,000/- for the purpose of releasing the car. It is alleged that, since the accused persons threatened of committing the murder of the first informant if he fails to pay the money, he had approached the Police and based on his first information, FIR was registered against Arshad and others for the - 5 - HC-KAR CNR: KAHC010594182026 NC: 2026:KHC:51456 CRL.P No. 13143 of 2026 offences punishable under Section 308(4) read with Section 3(5) of BNS, 2023. 5. It is not in dispute that the petitioner’s name is not found in the FIR. During the course of investigation, the petitioner was arrested on 15.12.2025 and was released on bail by the jurisdictional Court of Magistrate on 18.12.2025. It appears that subsequently, the provisions of the KCOC Act, 2000 was invoked in the present case as against the accused and therefore, the bail granted to the petitioner at the crime stage by the learned Magistrate was cancelled by the Court of Special Judge. Thereafter, the petitioner was arrested on 11.06.2026 and remanded to judicial custody. After completing investigation, charge sheet is filed in the case, wherein the petitioner is arrayed as accused No.9. In the charge sheet it is alleged that the petitioner had taken the aforesaid car to Sirsi and had mortgaged the same with CW-20 for a sum of Rs.2,00,000/- and had handed over the said amount to accused No.8. He has no other criminal antecedents. 6. Under the circumstances, I am of the opinion that the prayer made by the petitioner for grant of regular bail needs to be answered affirmatively, subject to appropriate conditions. Accordingly, the following: O R D E R i) The Criminal Petition is allowed. ii) The petitioner is directed to be enlarged on bail in Special Case No.218/2026 pending before the Court of the Principal District and Sessions Judge, Mysuru, arising out of Crime No.175/2025, registered by Kankanady Town Police Station, Mangaluru City, for the offences punishable under Sections 115(2), 118(1), 351(3), 308(5), 249 read with Section 190 of BNS, 2023 and Sections 3(1), 3(2), 3(3), 3(4) of the KCOC Act, 2000, subject to the following conditions: - 7 - HC-KAR CNR: KAHC010594182026 NC: 2026:KHC:51456 CRL.P No. 13143 of 2026 a) The petitioner shall execute personal bond for a sum of Rs.1,00,000/- with two sureties for the likesum, to the satisfaction of the jurisdictional Court; b) The petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts his appearance for valid reasons; c) The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses; d) The petitioner shall not involve in similar offences in future; e) The petitioner shall not leave the jurisdiction of the Trial Court without permission of the said Court until the case registered against him is disposed off.
