Affidavit of service filed by the petitioner is taken on record. The petitioner being the Pradhan of Daldali Gram Panchayat submitted an application before the Prescribed Authority seeking removal of the private respondents under Section 11(1)(d) of the West Bengal Panchayat Act, 1973 which is still pending. The petitioner seeks a direction upon the Prescribed Authority to consider the same at the earliest.
Learned counsel for the petitioner submits that pursuant to the application filed by the petitioner, a report was called for from the Pradhan of the Panchayat by the Block Development Officer. Such report has been submitted and sent to the Sub-Divisional Officer for
consideration.
2 In view of the fact that the application under Section 11 (1)(d) of the act is pending for a considerable period of time, the Prescribed Authority and Sub-Divisional Officer, Purulia Sadar, being the 5th respondent herein, is directed to consider and dispose of the same within two weeks from the date of communication of this order upon granting reasonable opportunity of hearing to all concerned including the petitioner and the private respondents in accordance with law. The decision taken by the authority shall be communicated to the parties within a week thereof. The writ petition is disposed of accordingly. There shall, however, be no order as to costs. Since no affidavit is invited, the allegations contained in the writ petition are deemed not to have been admitted. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities. (Suvra Ghosh, J.)
