1. Affidavit of service filed on behalf of petitioners is taken on record.

By presenting this writ petition petitioners being senior citizens pray for transfer of investigation of Narendrapur Police Station Case No. 1058 of 2024 dated 3rd September, 2024 to Central Bureau of Investigation (CBI). This Court has heard the learned advocates representing petitioner, CBI and State respondents.
3. It is submitted on behalf of petitioners that
order passed by the Hon’ble Supreme Court on 1st December, 2025 in Suo Motu Writ Petition (Crl.) No(s). 3 of 2025 applies in the present case since allegation is petitioners have been
2 defrauded and eventually parted with sum of Rs. 2.66 crores. Further allegation is petitioners being senior citizens are victims of digital arrest. At the same time grievance is expressed relating to manner of investigation being carried out by the State police authorities after registering Narendrapur Police Station Case No. 1058 of 2024 dated 3rd September,
2024.
4. In view of order passed by the Hon’ble Supreme Court on 1st December, 2025 in Suo Motu Writ Petition (Crl.) No(s). 3 of 2025 this Court finds substance in the contention made on behalf of petitioners. In paragraph-5 of said order dated 1st December, 2025 it was directed by the Supreme Court that CBI shall be primary agency to investigate cases reporting digital arrest scams. In paragraph 6(iv) of said order dated 1st December, 2025 it was further
directed by the Hon’ble Supreme Court upon all State Governments and Union Territories that under Section 6 of the Delhi Special Police Establishment Act, 1946 sanction shall be accorded so that the CBI can undertake a comprehensive action in respect of identified cyber crimes, on a Pan India basis.
5. In view of aforesaid directions contained in
order dated 1st December, 2025 concerned
3 authority of Narendrapur Police Station is
directed to handover case diary and other relevant materials to the representative of CBI, Economic Offence Branch (EO-III), New Delhi by 10 (ten) days from date. Concerned authority of CBI, Economic Offence Branch (EO-III), New Delhi shall send its authorised representative to Narendrapur Police Station for handing over of documents and case records. After receipt of materials and case diary concerned authority of CBI is directed to take steps accordingly.
6. Writ petition stands disposed of.
