And In the matter of : Munna Singh ……Petitioner. Mr. Sabir Ahmed Mr. Dhiman Banerjee Mr. Quazi Ezaz Ahmed ......for the Petitioner. Mr. L. Vishal Kumar Mr. Sanjib Das ……for the State. Learned advocate appearing for the petitioner submits that petitioner is having drug license and trade license to carry on business of pharmacy trades, in spite of the same, petitioner has been arrested for storing cough syrup amounting to 40740 bottles of codeine phosphate. Petitioner was arrested on 04.02.2026 and since then he is in custody for more than seven months. It has been contended that so far as the godown of the present petitioner is concerned, document has been enclosed along with the supplementary affidavit. Petitioner is an income tax payee and regular businessman of the locality and has been victimized after there was some local dispute pertaining to certain political issues. Learned advocate appearing for the State has submitted a report as also the Case Diary. 2 So far as the godown which has been claimed by the petitioner the same has not been denied by the State but additionally the place of seizure has been substantiated by way of statement of the landlady along with two local witnesses. Seizure list also reflects regarding the place of seizure, there is video recording of the said seizure, prima facie, I am of the view that there is evidence to substantiate (subject to cross-examination by the petitioner) to establish a case. Having regard to the same, at this stage, without the cross- examination of the relevant witnesses, I am not inclined to release the petitioner on bail. Accordingly, CRM (NDPS) 1365 of 2026 is rejected at this stage. Memo of evidence submitted by the State be kept with the record. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities. (Tirthankar Ghosh, J.)
