Sl.16 22.09.2026 Court No.6 BP C.O. 3155 of 2026 Sri Anup Ghosh -versus- Jatan Ghosh Mr. Prasanta Kumar Pakrashi ..for the petitioner The order dated 19th August, 2026 passed by the learned Civil Judge (Senior Division), Katwa, Purba Bardhaman in Title Suit No. 33 of 2026 thereby allowing the application under Order 39 Rule 1 and 2 of the Code of Civil Procedure is under challenge in this civil revisional application. The impugned order is an appealable order under the provisions of Order 43 Rule 1(r ) of the Code of Civil Procedure. In view thereof, this Court is not inclined to entertain this civil revisional application. At this stage, the learned advocate appearing for the petitioner prays for leave to withdraw this civil revisional application with liberty to approach the appropriate forum in accordance with law. In the light of the aforesaid submission made by the learned advocate for the petitioner, C.O. 3155 of 2026 stands dismissed as withdrawn with liberty to the petitioner to approach the appropriate forum in accordance with law. 2 The learned advocate on record of the petitioner shall be permitted to take back the certified copy of the order impugned by replacing the same with photostat copy thereof.
