Shome Mr. Sailen Naskar …. For the State Mr. MIR Anuruzzaman …. For the municipality Mr. Dilip Kumar Shyamal Mr. Pratap Kumar Yadav …. For the respondent Nos. 7-8 1. Complaining illegal construction in the form of encroachment of the petitioner’s land at the instance of the respondent Nos. 7 and 8, the instant writ petition has been filed. 2. Having heard the learned advocates appearing for the respective parties, I am of the view there is no scope to the municipality to determine whether there has been any encroachment or not. However, since a complaint has been made, the municipal authority is directed to enquire into the fact as to whether there is any sanctioned building plan in respect of the premises in question. Let such enquiry be conducted by the municipality within a period of six weeks from the date of communication of this order upon giving notice to all interested parties. WPA 23981 of 2026 2 3. With the above observations and directions, the writ petition is disposed of. (Raja Basu Chowdhury, J.)
