Heard Mr. K. Rahman, learned Counsel for the petitioner and Mr B. Sharma, learned Special Public Prosecutor, Wildlife. By this application, the petitioner has sought for bail in connection with
Page No.# 2/3 Orang National Park Offence Report No. 01 of 2026 dated 23.02.2026 for violation of Sections 2/9/39/49B/52 of the Wildlife Protection Act, 1972 punishable under Section 51 of the said Act. The allegation against the petitioner is that the petitioner was found in the possession of an endangered species namely Gecko, which was kept in Swargadew Family cum Restaurant situated at Besimari. It is further alleged that the petitioner is a habitual offender and can commit similar offence in future. Mr. K. Rahman, learned Counsel for the petitioner submits that the accused person has been in jail for 15 days as of today and he has given statement before the Police Officer and the Gecko was also released to the Orang National Park and as such prays that under any condition, he may be granted bail. Mr B. Sharma, learned Special Public Prosecutor, Wildlife however, submits that the petitioner was found in possession of such an endangered species and the petitioner had kept it for sell and as such the petitioner deals with the said illegal trading, which was in clear violation of the Wildlife Protection Act, 1972. On consideration of the submissions made by the parties more so due to the fact that the Gecko, which was found in possession of the petitioner was released to the Orang National Park and that the petitioner had also given his statement. This Court deems it fit that the petitioner be released on bail on furnishing of a bail bond of Rs. 20,000/- with one local surety of the like amount to the satisfaction of CJM, Darang, Mangaldai under the following conditions: i) The petitioner will appear before the Trial Court as and when call for.
