THIS PETITION, COMING ON FOR PRELIMINARY HEARING, THIS DAY, ORDER WAS MADE THEREIN AS UNDER: - 9 - HC-KAR NC: 2026:KHC:17978 WP No. 9085 of 2026 CORAM: HON'BLE MR. JUSTICE SACHIN SHANKAR MAGADUM ORAL ORDER The captioned petition is filed alleging inaction on the part of the respondents, who have failed to consider the petitioners' representation dated 27.11.2025, vide Annexure-E. 2. Facts leading to the case are as under: Learned Additional Government Advocate, though seeks time to obtain instructions, this Court is not inclined to grant any adjournment in the matter. This Court has, on several occasions, deprecated the practice of authorities keeping representations submitted by citizens pending for an indefinite period without any decision. Such inaction on the part of the State and its instrumentalities compels citizens to approach this Court under Article 226 of the Constitution of India, seeking a writ of mandamus. The conduct of the respondents in sitting over the - 10 - HC-KAR NC: 2026:KHC:17978 WP No. 9085 of 2026 petitioners9 representations reflects palpable administrative apathy and inaction. 3. It is trite that when a representation is submitted invoking a statutory or legal right, the concerned authority is under a corresponding obligation to consider and decide the same within a reasonable time. The petitioners herein are asserting a claim for parity in pay scale based on the Government Order dated 17.07.2019, published in the official gazette and produced at Annexure-A. Whether the benefit flowing from the said notification is applicable to the petitioners or not is a matter that squarely falls within the domain of the respondent-authorities and requires due consideration on merits. 4. In the present case, despite submission of representations dated 23.04.2025 and 27.11.2025, the respondents have failed to take any decision. Such inaction cannot be countenanced. The petitioners, being employees working under the authority, have a legitimate - 11 - HC-KAR NC: 2026:KHC:17978 WP No. 9085 of 2026 expectation that their grievances would be duly examined and addressed in accordance with law. Therefore, this Court is of the considered view that the inaction on the part of the respondents warrants interference and this is a fit case for issuance of a writ of mandamus directing consideration of the petitioners9 representation in accordance with law. 5. For the foregoing reasons, this Court passes the following: ORDER i. The writ petition is hereby allowed; ii. A writ in the nature of mandamus is issued directing the respondents to consider and dispose of the petitioners9 representation dated 27.11.2025 produced at Annexure3E, in accordance with law; iii. While considering the said representation, the respondents shall specifically examine the - 12 - HC-KAR NC: 2026:KHC:17978 WP No. 9085 of 2026 claim of the petitioners for extension of benefit under the Government Notification dated 17.07.2019 produced at Annexure3A, and determine the petitioners9 entitlement thereto; iv. The aforesaid exercise shall be completed within an outer limit of eight (8) weeks from the date of receipt of a certified copy of this order; v. It is made clear that this Court has not expressed any opinion on the merits of the claim, and all contentions of the parties are kept open.
