ORAL ORDER
Accused No.4 in Crime No.656/2026 registered by Madanayakanally Police Station, Bengaluru City, for the offences punishable under Sections 310(2) and 61(2) of BNS, 2023, is before this Court in this petition filed under Section 483 of BNSS, 2023, seeking regular bail.
2. Heard the learned counsel for the parties.

FIR in Crime No.656/2026 was registered by Madanayakanally Police Station, Bengaluru City for the offence punishable under Section 309(4) of BNS, 2023, against three unknown persons, based on the first information dated 06.07.2026 received from Smt. Rathnamma W/o. Late Chandru. In the said case, the petitioner was arrested on 31.07.2026 and remanded to judicial custody. His bail application filed before the jurisdictional Sessions Court in Crl.Misc.No.1721/2026 was rejected on 14.08.2026. Therefore, he is before this Court.

Learned counsel for the petitioner submits that FIR has been registered against three unknown persons. The petitioner is arrayed as accused No.4 in his remand application. Accused Nos.3 and 5 as against whom similar allegations are found, have been subsequently granted regular bail by the very same Sessions Judge in Crl.Misc.No.1807/2026 and Crl.Misc.No.1844/2026. The petitioner has no other criminal antecedents. Accordingly, he prays to allow the petition. 5. Learned HCGP has opposed the petition. 6. It is the case of the prosecution that, on 06.07.2026, when the first informant and her friend Vijaya were talking to Manjula and Anitha, three persons all of a sudden entered her house, threatened the inmates of the house with a machete, snatched her gold mangalya chain, two finger rings and cash of Rs.27,500/- and escaped from the spot on the two-wheeler in which they had arrived. 7. During the course of investigation, the petitioner was arrested and in the remand application, he is arrayed as accused No.4. Accused Nos.3 and 5 were also arrested in the present case during the course of investigation and have now

been granted regular bail by the learned Sessions Judge in Crl.Misc.No.1807/2026 and Crl.Misc.No.1844/2026. 8. A reading of the remand application of the accused would reveal that the allegations against the petitioner and accused Nos.3 to 5 are similar. It is not in dispute that the petitioner has no other criminal antecedents. Major portion of the investigation is already completed. 9. Under the circumstances, I am of the opinion that the prayer made by the petitioner for grant of regular bail needs to be answered affirmatively, subject to appropriate conditions. Accordingly, the following:
O R D E R
i) The Criminal Petition is allowed.
ii) The petitioner is directed to be enlarged on bail in Crime No.656/2026 registered by Madanayakanally Police Station, Bengaluru City for the offences punishable under Sections 309(4), 310(2) and 61(2) of BNS, 2023, subject to the following conditions:
a) The petitioner shall execute personal bond for a sum of Rs.1,00,000/- with two

sureties for the likesum, to the satisfaction of the jurisdictional Court;
b) The petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts his appearance for valid reasons;
c) The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses;
d) The petitioner shall not involve in similar offences in future;
e) The petitioner shall not leave the jurisdiction of the Trial Court without permission of the said Court until the case registered against him is disposed off. Sd/- (S VISHWAJITH SHETTY) JUDGE
