Learned advocate appearing for the petitioner submits that petitioner was produced before the learned Special Court after 36 hours. None of the orders of the learned Special Court reflects that the said issue was canvassed before the learned Special Court. Learned advocate appearing for the State has submitted a report wherein they claimed that after 23 hours the accused was produced before the Court but prior to the statutory mandate. If the petitioner has materials in his possession, petitioner will canvassed such issue before the learned jurisdictional Court/Special Court on the next date fixed. So far as the issue on merits is concerned, at this stage, this Court is not interfering on the same. With the aforesaid observations, CRM (M) 1680 of 2026 is disposed of.
2 Memo of evidence submitted by the State be kept with the record. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
